The state protects the authorities
Ayşe Tuba had filed a criminal complaint 23 times about the man who killed her. However, nobody heard her voice. Ayşe was killed in the street after being attacked. The state ignored her complaints is now protecting those who ignored her voice. “Yes, the killer has been sentenced to prison. But Ayşe could be alive now. Those responsible for this incident haven’t been tried. Why haven’t they been tried, because the state’s fault would be revealed,” says lawyer Heval Yıldız Karasu.
News Center-Ayşe Tuba had got four protection orders and filed many criminal complaints but she wasn’t protected. Ayşe was attacked in the street in front of everyone. After she was taken to hospital, her 23rd criminal complaint petition was found in her bag. In her last petition, she wrote she wasn’t protected despite protection orders. She also wrote, “I apply to all legal transactions about this person named Yalçın Özalpay. I receive death threats from this person. Will you help me when I will be killed?”
Ayşe had filed 23 criminal complaints about Yalçın Özalpay before she was killed publicly. When her lawyers made an application for their clients, the state takes its judges, polices, and experts under protection. The investigations opened against the authorities were concluded. They found “No Evidence of Negligence”.
What will happen to those responsible for prevention?
The lawyer Heval Yıldız Karasu notes that the murderer received the prison sentence he deserves, “That’s good. But what will happen to those responsible for prevention? There are things the state must do to prevent murder. The court sentences the murderer to prison sentence but nothing has been done for those responsible for prevention.”
Underlining that Ayşe Tuba filed a complaint to the police but the police never took any action to prevent the femicide, Heval Yıldız Karasu says, “The police did not stand in front of the killer as a prevention mechanism. Police units did not receive any punishment although they did not fulfill their duties. Yes, the killer has been sentenced to prison. But Ayşe could be alive now if they had fulfilled their duties. Those responsible for this incident haven’t been tried. Why haven’t they been tried? If they were tried, the state’s fault would be revealed.”
